Terms and Conditions

By using the Cherry app or the ordering page at cherrycupcafe.com, you agree to these terms. The service is provided by Sabbar Alqahwa Trading Establishment (“Cherry”).

Your account

• You register with a Saudi mobile number that you own, and you are responsible for keeping your details accurate.
• Your account is personal and may not be shared or transferred. You are responsible for all activity on it.
• We may suspend an account in cases of misuse or attempts to game our offers.

Pre-ordering

• Orders are for pickup from Cherry. Displayed prices include VAT.
• Your order is sent to the branch once payment is confirmed. The branch has a limited time to accept it; if it is not accepted in time, the order expires automatically.
• The arrival time you choose is not the time your order will be ready; follow its status in the app.
• If an item is unavailable because it has sold out, we will let you know and refund the amount.

Payment and refunds

• Payment is made online through Moyasar (mada, Visa, Mastercard, Apple Pay).
• If your order is rejected or expires before it is accepted after payment, the full amount is refunded to the same payment method within the time set by your bank.
• Once the branch has accepted your order and started preparing it, it cannot be cancelled, unless the error was on our side.
• Orders not collected on the same day are not refundable.

Cherry points

• Points = the amount you pay ÷ 10, on all items, in the app or in the shop. Points are counted with fractions and kept to two decimal places (for example SAR 27 = 2.7 points).
• In-store purchases count only if you show your membership code to the cashier at the time of purchase and they add your points.
• Each point is SAR 1 off an order in the app, from 5 points, fractions included, up to the order value. Points can currently be used in the app only.
• Points expire 6 months after they are earned; the oldest are used first.
• Welcome gift: one free cup when you register for the first time, once per mobile number.
• Birthday gift: one free cup, valid for 7 days from your registered birthday. Your date of birth can be set only once and cannot be changed.
• Points and rewards have no cash value, cannot be exchanged for cash or transferred to another person.
• Points earned on cancelled or refunded orders are removed, and points or a reward used on an order that was not fulfilled are returned to you.
• When you delete your account, your points and rewards are permanently cancelled.
• With the launch of points, the previous stamp card ended; free cups completed before then remain valid.
• Cherry may change or end the program with prior notice in the app, without affecting points and rewards earned before the change.

Acceptable use

You may not use the service for any unlawful purpose, create fake accounts, or attempt to gain unauthorised access to our systems.

Liability

We do our best to keep the service available and accurate, but it is provided “as is”, and we are not liable for indirect damages caused by interruptions. This does not affect your rights under the Saudi Consumer Protection Law.

Governing law

These terms are governed by the laws of the Kingdom of Saudi Arabia, and its courts have jurisdiction over any dispute.
